Desalniettemin heeft rechter Roger Benitez zijn plicht en verplichting niet nagekomen. De valse wet die het bezit en de verwerving van wapens verbiedt, moet ab initio &quot;ongeldig&quot; worden verklaard en de rechtbank moet de wetgevende macht bevelen om de opzettelijke overtreding volledig af te keuren. De reden dat deze rechter dit niet doet, is omdat hij weet dat zijn gezag ook een nietigheid is. De Amerikaanse districtsrechtbanken vallen buiten de status van artikel III. Deze zaak valt buiten artikel III Standing.
